The case of the $13 million comma and why grammarians are rejoicing

Portland-based company Oakhurst Dairy will potentially owe $US10 million ($13 million) to 75 milk-truck drivers in the US state of Maine because of a missing comma in a legal clause.


Last week, Judge David J Barron upheld an appeal in a class-action lawsuit, opening his opinion with: "For want of a comma, we have this case."


Three dairy-truck drivers sued Oakhurst Dairy in 2014 for four years of unpaid overtime wages.


The case hinged on the missing comma after "packing for shipment" in the following clause of Maine state law, which lists exemptions from overtime:


The canning, processing, preserving, freezing, drying, marketing, storing, packing for shipment or distribution of: Agricultural produce, Meat and fish products; and Perishable foods


The missing comma, in this case, would have separated "packing for shipment" and "distribution" into distinct activities, both exempt from overtime.


Without the comma, the drivers argued, the law referred only to the act of packing, for the purpose of either shipping or distributing.


There are other grammatical issues with this clause (neatly unpacked in more detail by Mary Norris in The New Yorker), but David Webbert, a lawyer for the drivers, told The New York Times: "That comma would have sunk our ship".

Federal MP Stuart Robert called as witness in council corruption probe
After the March 31 elections, it was alleged Mr Robert channelled tens of thousands of dollars from his federal Liberal National Party campaign fund, the Fadden Forum, to council candidates who stood as independents.

Mr Robert has confirmed he gave candidates Kristyn Boulton and Felicity Stevenson $30,000 each from the Fadden Forum to run their campaigns.

Both are former staffers in Mr Robert's electorate office.

He denied he was trying to influence the council's composition, but admitted he wanted to stop any potential Labor candidates making it onto the council.

Tasmania could become 'battery of Australia' through increased dam storage, Turnbull says


Plans are in the pipeline to double Tasmania's hydropower output by re-using water, with Prime Minister Malcolm Turnbull announcing new feasibility studies to investigate.


Mr Turnbull visited Tasmania's Trevallyn Power Station to make the announcement, flanked by Premier Will Hodgman and Federal Energy Minister Josh Frydenberg.


The studies will support feasibility work into redeveloping the aging Tarraleah scheme and enhancing the Gordon Power Station.


The Australian Renewable Energy Agency (ARENA) is also considering an application from Hydro Tasmania to explore several new pumped hydro energy storage schemes that could deliver up to 2500 MW of pumped hydro power, which could lead to hundreds of millions of dollars worth of investment.


"What we're seeing here in Tasmania is the opportunity in this state to provide even more renewable energy, wind and hydro, than it does today," Mr Turnbull said.


"There's the opportunity here in Tasmania to double the capacity of Hydro Tasmania with new investment and with pump storage, and of course it has the best wind assets in Australia — the Roaring Forties."


Mr Turnbull said, if implemented, the plan could see Tasmania become the "battery of Australia".
